General Terms & Conditions

Please read these terms and conditions (“terms”, “terms and conditions”) carefully before using the Home – Slim Skin and/or Home – Liposculpt websites (the “service”) operated by Liposculpt (Pty) LTD (“us”, “we”, or “our”).

Your access to and use of the service is conditioned on your acceptance of and compliance with these terms. These terms apply to all visitors, users and others who access or use the service.

By accessing or using the service you agree to be bound by these terms. If you disagree with any part of the terms, then you may not access the Service.

Detailed description of goods and/or services

Liposculpt (Pty) LTD owns and operates two businesses in the Beauty & Aesthetic industry namely SlimSkin and LipoSculpt. These businesses provide services and products for this industry. In addition, Liposculpt (Pty) LTD sells gift cards for redemption of these services and products.
Services refers to treatments including, but not limited to, slimming, skin care and laser hair removal treatments, unless otherwise specified.

Social media and other competitions

Social media and other Competitions open and close on a stipulated date.
Competitions are open to all except the employees and family members of Liposculpt (Pty) LTD as well as respective advertising and promotional agencies, media and PR agencies of Liposculpt (Pty) LTD.
By entering the competition, all participants accept and agree to abide by these rules, terms, and conditions.
Winners will be chosen from any of the various social media platforms. Only 1 winner out of all platforms will be selected.
Prizes are not transferable and may not be exchanged for cash.
The judges’ decision is final.
If the winner does not email their details within 1 week after the competition closes, the prize will be forfeited to a runner-up.
The winner may be required to take part in marketing activities and participation in the competition is conditional upon agreement to take part in such activities. Participants will not be entitled to any payment or other remuneration for any such activities or otherwise.
Should prevailing circumstance or stock shortages prevent prize fulfilment Liposculpt (Pty) LTD reserves the right to substitute the prize with any other prize of comparable commercial value.
All and any materials, including publicity materials and any other intellectual property, will be the sole property of Liposculpt (Pty) LTD.
Liposculpt (Pty) LTD reserves the right to terminate, temporarily suspend or amend any promotion in the event of any unforeseen circumstances outside their reasonable control, technical or other difficulties that might compromise its integrity.
Neither Liposculpt (Pty) LTD nor their respective advertising, media, and PR agencies, nor their trading partners shall be liable in any way whatsoever for any loss, damage, or costs, howsoever arising, suffered by an entrant of a competition and/or participant in the prize offered.
Under no circumstances shall Liposculpt (Pty) LTD be liable to anyone who enters this competition for any indirect or consequential loss, howsoever arising, which may be suffered in relation to the competition, whether because of any negligent act or omission or any default on the part of Liposculpt (Pty) LTD or otherwise.
The laws of South Africa govern these terms and conditions and participants agree to be subject to the exclusive jurisdiction of the South African courts.

Gift Vouchers

Only one gift voucher can be used at a time.
A gift voucher cannot be applied on a special offer (the biggest discount will be applied).
Gift Vouchers are valid for 1 year (12 months) from promotional / campaign date, unless specified differently on the voucher.
Gift vouchers purchased for any value cannot be refunded in monetary form.
Any credit remaining from a purchase by gift voucher will remain in the clients account to be redeemed at a later stage. This credit does not expire.

On-line and electronic promotions

All promotions sent via email, SMS or on social media are valid for the month stipulated on the promotion only unless specified otherwise.

Links To Other Web Sites

Our Service may contain links to third-party web sites or services that are not owned or controlled by Liposculpt (Pty) LTD.
Liposculpt (Pty) LTD has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party web sites or services.
You further acknowledge and agree that Liposculpt (Pty) LTD shall not be responsible or liable, directly, or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods, or services available on or through any such web sites or services.
We strongly advise you to read the terms and conditions and privacy policies of any third-party web sites or services that you visit.

Pricing

All prices are correct at time of printing and are subject to change from time to time.
Liposculpt (Pty) LTD reserves the right to change, amend, alter, or withdraw treatments without prior notification.

Loyalty Points at LipoSculpt

Clients acquire loyalty points as follows: for expenses on treatments and on products, for every R2 you spend you receive 1 loyalty points.
Every loyalty point is worth R0.10 or 10 loyalty points is worth R1.
Terms and Conditions: loyalty points can only be redeemed for treatments (excluding micro-needling) and not for products, points are not transferable, points cannot be exchanged for cash, points can be used to purchase a gift voucher, points never expire.

Personal contact information of staff

Please note that staff are not allowed to exchange personal contact information with clients as it in contravention of their employment contract with Liposculpt (Pty) LTD.
Bookings are only valid when made through Liposculpt (Pty) LTD channels.

Variation

Liposculpt (Pty) LTD may, in its sole discretion, change this agreement or any part thereof at any time without notice.

Changes

Liposculpt (Pty) LTD reserve the right, at its sole discretion, to modify or replace these terms at any time.
If a revision is material, we will try to provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our service after those revisions become effective, you agree to be bound by the revised terms.
If you do not agree to the new terms, please stop using the service.

Termination

We may terminate or suspend access to our service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the terms.
All provisions of the terms which by their nature should survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Country of domicile

This website is governed by the laws of South Africa and Liposculpt (Pty) LTD chooses as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature.

Governing Law

These terms shall be governed and construed in accordance with the laws of South Africa, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these terms will not be considered a waiver of those rights.
If any provision of these terms is held to be invalid or unenforceable by a court, the remaining provisions of these terms will remain in effect.
These terms constitute the entire agreement between us regarding our service and supersede and replace any prior agreements we might have between us regarding the service.
